Review FDA Regulations and Senate Discussions

To all our Vape Shop owners in the Austin Area and Round Rock TX.  We firmly believe that this legislation with FDA Regulations is a BIG LIE.  We need to provide clarity to our Senators and Representatives. In my opinion, they are misguided and misinformed.  Either that, or Big Tobacco is paying a large sum of money to deliver this message through our Senators.

In order for our customers to purchase and use electronic cigarettes, vapor pens, MODS or modified devices, and the selection of eLiquid they like, we must continue to have our voices heard throughout Austin, Round Rock, TX and surrounding areas.

Let me explain:

THE BIG LIE

Watch this clip:  What you will discover is how Senator Jeff Merkley begins to distort the truth.
He speaks about the Tobacco Companies as if it is Big Tobacco Manufacturers.  You will begin to see an evolution through the videos that what he is actually doing is creating the illusion that vapor products are tobacco.  As soon as they can connect these dots, utilizing "candy flavors" and "Nicotine" as the primary discussion, it becomes an industry targeting young children to begin the path of smoking harmful cigarettes.

The fact is Big Tobacco does not market "Candy Flavors".  Another fact is that the flavors we have in our shops are not a result of marketing to children.  It is what our customers "Adults" are demanding we have in stock.

  • Marlboro-maker Altria Group Inc., the nations largest "tobacco company" has the vapor brand MarkTen.

  • The second-biggest U.S. tobacco company, Reynolds American has VUSE electronic cigarette.
  • The third-largest U.S. Tobacco company, Lorillard Inc., acquired BLU e-cigarettes sold at U.S. convenience stores.  This one is the only one that comes close to flavors - Vanilla, Pina Colada, and Peach Schnapps - definitely not candy flavors - cotton candy, bubblegum, etc.

So if Big Tobacco is not promoting candy flavors - what tobacco company are they talking about? You can't substantiate the idea without folding Vape Shops into the discussion.  We are a separate business model with very different objectives.

Do you think, as consumer that Big Tobacco companies will deliver a quality product?  Or will their motivation be to put an inferior vape pen e-cigarette out so that consumers will get frustrated and go back to smoking?

HR2058 IS THE ANSWER
You do not have to sit idly by and watch your right to vape go up in Big Tobacco smoke. Congressman Tom Cole of Oklahoma’s 4th district has sponsored a bill to protect your right to vape. HR 2058 will require the FDA to change the grandfather date from February 2007 to the point in time where regulations go into effect.
Congressman Cole’s bill will prevent the FDA from being able to ban 99% of all vaping products. HR 2058 shows that the vaping community and American small business does have a voice in Congress and that the vaping community does have the opportunity to reinforce that voice. You have a role in your government and it’s time to exercise that role.
It is time for us to step up as a community. We can step forward with strength and dignity. Let’s leave the mud slinging and cheap shots to the anti-vaping zealots who have made it their daily routine to lie about the dangers of electronic cigarettes. Let’s take the high road and present our case in a sound, reasonable and respectful fashion that mirrors the worthiness of our cause.

On10/28/2015, tens of thousands of harm reduction advocates took to the phone lines urging President Obama to demand that the FDA reconsider the damage that will be caused by implementing the current draft of their tobacco deeming regulations. There were so many people calling in that many of you were unable to get through.

Well, it’s perfectly reasonable for you to try again today.

If you have not already done so, it is critical that you send an email to your Congressional representative and Senators asking them to support and co-sponsor HR 2058, a bill that would stop the FDA from banning 99%-plus of vapor products.

Here are the rest of the Senators and their positioning with a serious misunderstanding of the vaping industry. Watch and be amazed! Watch and get upset! Watch and then take some serious action!

Watch Senator Edward Markey "only" refer to BIG Tobacco. This is a play on words and our industry. In my opinion, he is either mislead or this whole thing is a well orchestrated BIG LIE to the president of the United States and the American Public.



Same Story - Different Guy - Sen. Richard Blumenthal sends another candy message in the Video Below.  


Watch below as Sen. Elizabeth Warren neglects to acknowledge that decline in smoking cigarettes stalled, only to pick up with the introduction of vaping products.  She begins to NOW tie this into a tobacco company marketing to youth pulling vaping as a tobacco product.  Count how many times she says "tobacco". I lost count.


So to tie it all together, Sen. Jeff Merkley See Below - The FDA, with the full support of Big Tobacco, wants to regulate E-cigarettes as a tobacco product.  In doing so, they will establish guidelines for “Good Manufacturing Practices,” which will require consistent product performance and reduced variability.  To fulfill these requirements, Big Tobacco will modify it’s processes of reconstituted tobacco to make their E-liquid blends more addictive and consistently uniform.  There will be very few smaller, private, proprietorship or LLC-based E-cigarette companies who can even dream of ever being able to afford the manufacturing equipment, not to mention labor, energy, insurance, etc. costs required for the process of tobacco reconstitution.  And without that equipment, they will never be able to meet the FDA’s regulatory requirements.  So, there you have it.  Corporate America wins again by standing on our shoulders to reach their goal, then after they have a firm grasp they reach down with a scimitar and decapitate us.  Say goodbye to your three-ingredient E-juices unless you take action NOW.  Gotta love the ingenuity of the ultimately corrupt and the absolutely greedy.
